Promotions after exceptional growth at NSDV
NSDV, Africa’s first fully integrated law and consultancy firm specialising in mining, construction, and environmental law announced three senior promotions after growing the firm from three founding members to 28 legal/ corporate consultants and support staff over the past three years.
“Growing our business during the pandemic climate has been challenging, but our philosophy towards people and their growth has allowed us to reward exceptional leadership and avoid the usual ‘bide-your-time’ gauntlet many legal practitioners face,” says Co-founder and Director Lili Nupen.
“We offer an intimate team structure that doesn’t rely on traditional hierarchy and policies to reward exceptional results for our clients,” continues Nupen.
Samantha Reyneke is promoted from General Commercial Litigator, operating particularly within the realms of disputes arising from construction and engineering, business rescue, and product liability, to Director in the Construction Department at NSDV.
“Reyneke will help manage and grow the construction and dispute resolution department at NSDV, generating bespoke construction contracts across Africa. Her attention to detail, industry knowledge, and natural leadership abilities makes her the perfect Director for our department,” says Cameron Staude, Co-Founder and Director of Construction at NSDV.
When asked about her promotion, Reyneke comments that she is very excited to be growing into a bigger role at a firm that she truly believes in and loves working at. “I am incredibly grateful to reach the goal I have been working towards since I commenced my legal career in 2006,” says Reyneke.
Muhammed Khan moves from his role as Senior Associate to Director in the Mining and Environmental Law Department. “A great part of Muhammed’s professional success lies in his ability to combine amassed regulatory knowledge with his experience in negotiating, drafting, and reviewing various complex commercial contracts,” notes Nupen.
Muhammed looks forward to growing the successful practice with an impressive client list backing it. “Whilst it is always great to have an established practice, culture is critical. NSDV’s culture allows people to grow at their own pace with as much support as is needed.”
Last but certainly not least, Sarah Forshaw has been promoted from Associate to Senior Associate in the Construction Department after only six months in her previous role. “My learning, growth, and development over the last six months has been exponential. I attribute this to my amazing leader, Cameron Staude who has taught me so much with great patience and kindness. My supportive team always ensure my smile is bigger than my to do list, and the positive work environment at NSDV fosters development for anyone producing results for our clients.”
ABOUT THE PROMOTEES
Position: Director – MINING & ENVIRONMENTAL LAW
Muhammed Khan is a Director in the Mining and Environmental Law Department of NSDV and has extensive experience advising clients on their rights and obligations under several pieces of legislation that impact the mining and petroleum industries in South Africa.
He has a substantial history of engagement with various governmental departments, including the Department of Mineral Resources and Energy (DMRE), the Petroleum Agency of South Africa, and the National Energy Regulator of South Africa. This engagement includes the drafting of various applications under the Mineral and Petroleum Resources Development Act (MPRDA), the Mine Health and Safety Act (MHSA), and the Gas Act. In addition, he has represented several mining companies in inquiries initiated in terms of section 65 of the MHSA, appearing before the DMRE’s health and safety inspectorate.

Position: Director – CONSTRUCTION & LITIGATION LAW
Samantha is a general commercial litigator, operating particularly within the realms of disputes arising from construction and engineering, business rescue, and product liability.
As a Director at NSDV in the construction and dispute resolution department, she’s experienced in generating bespoke construction contracts as well as in all the standard form contracts – including the FIDIC Suite of Contracts, NEC, JBCC, GCC and the MBSA Domestic Sub-Contract Agreement. Samantha has arbitrated in terms of both AFSA and the Association of Arbitrators Rules as well as the ICC and UNCITRAL Rules for arbitration and, with a heart for the community, was the Founding Member of the Yakha Isizwe Business Law Clinic in Soweto which she headed up from 2015 to 2019.

Position: Senior Associate – CONSTRUCTION & DISPUTE RESOLUTION LAW
In addition to being a Senior Associate at NSDV in the construction and dispute resolution department, Sarah is admitted as a notary.
With a solid background in general litigation and arbitration, she possesses specialised experience in construction-related disputes. Having worked to resolve large-scale disputes relating to renewable energy projects (both wind and solar), Sarah is equally au fair with the associated contracts – including EPC Contracts, O&M Contracts, Power Purchase Agreements and bespoke construction contracts. She has also arbitrated in terms of both AFSA rules and the ICC rules for arbitration.
